This page is here to define the rules of use related to the services suggested of MyCoHost.net. MyCoHost.net ("MyCoHost") sells online services, named services. To use the services you ordered, you have to accept this TOS ("TERMS OF SERVICE"). Your online order form is equivalent to your signature. When you order that means you have fully read this page and accepted it. As a result, any users ("consumers", "end users", "customers") who do not have a direct service (are not "DIRECTLY ASSOCIATED" to MyCoHost.net and maintain an ACTIVE ACCOUNT [you are up-to-date with all payments] are NOT covered by this terms of service, and as such, no guarantees as to service(s) are made. This includes, but is not limited to, clients (USERS) belonging to our USERS ("end-user"). Submitting an order and agreeing means you are totally OK with the TERMS OF SERVICE of MyCoHost.net. You agree that all the information's you provided are true and correct. At any moment, you have the right to modify the information you gave us under your control panel. For critical information's (like e-mail, names) you have to mail the support service of MyCoHost.net (support@mycohost.net).
If you do not agree with the TERMS OF SERVICE leave the order form immediately. Only users that accepted the TERMS OF SERVICE have the right to register and then get services from MyCoHost.net. If you already have an account, and you are in disagreement with our TOS (TERMS OF SERVICE), please mail the sales service (support@mycohost.net) to ask for a TERMINATION of your account. Thank you.
MyCoHost.net has the right to modify the TOS at any moment. Users that subscribed to one (or more) of MyCoHost.net's services will receive a mail to tell them about any modifications of the TOS. If you don't mail us to ask to terminate your account, we’ll consider that you still want to maintain your account and that you are still accepting our TOS.
When you subscribe to one of our services, you have to provide your real name, address and phone number. During your service period you will be able to modify your subscriber information. When you choose to terminate your account, we assure you that all data concerning your identity will be deleted from our servers instantly.
All charges/fees related to your subscription must be paid in advance. If you have purchased a “One of fee” account, these one-time fees must be paid in advance. The service will be useable only when the payment has been made. At the moment, we only offer PayPal and E-Gold payments. We guarantee that PayPal is a secure way to pay for our services. Your Payments aren’t refundable. We securely store all information related to the transaction to help authorities in their work in the case of a fraudulent transaction.
MyCoHost.net will only ever issue a refund, if it has been proven that we are at fault for neglect or another matter. A request for a refund is only deemed valid when submitted within seven days of the initial account opening (defined as the date of purchase). Examples of valid requests are:
· Severe downtime (constituted as greater than or equal to one days worth of downtime in any given calender month)
· Inadequate support (we remained unable to process your support requests)
MyCoHost.net’s decision is final as to the outcome of the refund request.
We can not be held responsible for any packet losses, capped bandwidth or any other matter that could affect the use of your services.
7.1-Free Hosting
We reserve the right to terminate accounts where free hosting (defined as hosting that was obtained at a zero cost to the end user) was provided, as this provides a security issue for our servers, and it is in our best interest to look after everyone on the server. Free hosting accounts are setup by ‘hackers’ (“a programmer who reaches a goal by employing a series of modifications to exploit or extend existing code or resources”) who make as many attempts as necessary to destroy the server and its content, or escalate to root privileges and cause havoc for all of our end users.
8-Guarantee of Service & Liability
MyCoHost.net guarantees a reliable and fast service. We can’t be responsible of any damages caused by a tier on your servers. We are connected on the best American & European backbones to ensure a good service. We do not guarantee your data's. So you have to maintain your own backup. MyCoHost.net isn’t responsible of any lost data or of any attacks against your data, or of any unauthorized access to your data. MyCoHost.net isn’t responsible of any intrusion in your personal data. The subscriber is responsible for all such risks. We are not responsible for any lost profits caused by your services being unavailable.
The user is responsible for the content he stores on his servers. We just provide Internet lines and web servers. We can not be held responsible for the content you host. Valid complaints of any illegal content will result of the instant termination of your account and attached services. MyCoHost.net will help authorities to resolve any problems related to your account about illegal use. You can’t use your account to store illegal content like : warez, porn, kiddie porn, spam resources, illegal porn, trademarks, defamatory content, pirated software, pirated music, pirated movies (this include all copyrighted materials all over the world), cracks, hack scripts, loop scripts, trade secrets. YOU AREN’T ALLOWED TO USE YOUR SERVICES TO STORE, SHARE ANY CONTENT THAT BREAK LAWS UNITED STATES OF AMERICA, IN THE STATE OF MICHIGAN & FRANCE. ANY ILLEGAL USE WILL RESULT IN INSTANT TERMINATION OF YOUR ACCOUNT AND ATTACHED SERVICES WITHOUT ANY POSSIBILITY OF REFUND.
We do not allow any kind of illegal content on our servers. We do not allow sites that provide storage, sale, distribution, hypertext link to, advertisement, promotion or hosting of material that is unlawful, defamatory, obscene, harmful, threatening, harassing, or an intrusion of privacy or publicity rights, or otherwise objectionable. We have a tolerance equal to 0 about that. Any violations of these rules will result in instant termination of your account and attached services without any possibility of refund.
If you use your services to offer or distribute any fraudulent goods, services, schemes or promotion (i.e. : make money fast, schemes, chain-letters, pyramid schemes), or submitting false data on any sign-up form, contract or online application through registration, or any fraudulent use of information obtained through your services, including, without limitation, use of credit card number, phone numbers, emails, or home addresses, your account will be instantly terminated without any possibility of refund.
12-Copyright or Trademark Infringement
Use of our services to provide any sort of transmission (by email, uploads, downloads, posting or otherwise) or storage of any material that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitalization and distribution of photographs from magazines, books, or other copyrighted source, and the unauthorized transmittal of copyrighted software is TOTALLY FORBIDDEN. This sort of infringement result of an instant termination of your account and attached without possibility of refund.
The privacy of our customers is very important for us. We defend individual rights. We believe that the information of any customers is strictly confidential. It is why we’ll never share your personal information to any third party. All information you fill or filled in our forms are only for our purpose. We only use this sort of information for internal use. Only the financial information is collected by third party we use to manage our payments (i.e. : PayPal). At any moments you can contact us, or change by yourself the information you have provided. You have the rights to view/modify any personal information we store about you.
Using your services to violate MyCoHost.net’s, servers, system, network security is prohibited and may result in criminal or civil liability. We will investigate such incidents involving such violations and cooperate with the proper law enforcement authorities if a criminal violation is suspected on our servers. This includes without limitation : - Viruses - Trojans Horses - Worms - Time Bombs - Cancel Bots - Or any sort of content that may damage any system, program, data or personal information's - Any sort of hacking or unauthorized access - Scanning - Flooding - Spamming - Spoof - Phishing - Overloading of systems - System attacks - Unauthorized monitoring of any data/traffic on any network We have the right to modify specifications of any accounts on our servers that may compromise the security of our servers or third party servers.
Spam is unauthorized on our servers. Using your plan to send mass e-mail messages (spamming) is strictly prohibited. Sending e-mail that contains false company information, false promotions, viruses, or malicious e-mails is strictly prohibited. Any violation of these rules will result on an instant termination of your account including a fee of $400 for damages caused by your usage. MyCoHost.net is the sole arbiter as to what constitute a violation of this rule.
You must be in agreement with our Terms of Service before using our services. Any violations of these Terms of Service could result in an instant termination of your account without refund. In subscribing, you agree with our Terms of Service.
MyCoHost.net may modify, at any moment, the Terms of Service. All current customers will be informed by e-mail of any modifications of these Terms of Service.
You agree to hold harmless and indemnify MyCoHost.net, the owners and their agents, partners, affiliates, and content partners, against any liability for any claims and expenses, including reasonable attorney’s fees and court costs, relating to any violation of the terms of this Agreement, including the Terms of Service or any content placed on the Service by you.
All mentioned rules apply FOR ALL OUR SERVICES.
20-Illegal Torrents, IRC and PROXY
POSITIVE IDENTIFICATION OF AN ACCOUNT SEEDING ILLEGAL TORRENTS WILL RESULT IN A SEARCH OF THE ENTIRE SERVER.
ANY ACCOUNTS FOUND HOSTING ILLEGAL TORRENTS WILL BE CANCELLED WITHOUT THE POSSIBILITY OF REFUND OR RE-ORDERING.
IRC networks cannot be run from our services (including but not limited to IRC Bots and IRC Servers)
PROXY SERVICES ARE FORBIDDEN ON OUR SHARED SERVICES ("RESELLER HOSTING"). PERMISSION IS GRANTED ON VIRTUAL SERVERS ("VPS") ON A CASE-BY-CASE BASIS, PROVING THEY ARE NOT RESOURCE ABUSIVE. DEDICATED SERVERS HAVE NO PROXY RESTRICTIONS.
Certain products that are offered by MyCoHost.net are assisted with the option of a free domain name, defined by a domain named that is registered and therefore owned by us. You are required to maintain your services with MyCoHost.net for a minimum of three (3) months ("minimum service length") in order to qualify for transfer of this domain name, where transfer is defined by ownership being removed from our possession and acquired to yours. By requesting your "free domain name" (or otherwise known), you agree to these terms and conditions as a whole, including, but not limited to, point twenty-one (21). Your domain name may only be used in accordance without our "Domain name regulations", which are available by request only. You have acknowledged this message and understand that you forfeit all right to ownership of any domain name(s) registered through us, if you do not meet the minimum service length requirement. You also accept that these and/or other rules can be changed at any time without question, or notification to anyone.
All products and services, either named or unnamed, remain the property of MyCoHost at all times. We reserve all rights and guarantees as to their use, and can be withdrawn at any time.
